Sadly I got a very black and white NO to being able to import from them. Basically the 21 year exemption goes away if the vehicle does not have it's original engine. The EPA compliance of the new engine is a whole other minefield. I argued that the s62 was available in an EPA compliant car that was sold in the states (e39) and he said that the engine in the car is not from a US car so that is irrelevant - in essence it's a RoW engine. I also spoke about the incredibly strict T\u00dcV rules that a build like this needed to adhere to and he just kind of shrugged his shoulders and said that would be irrelevant for EPA purposes as well. Not the answers I was hooping for but better to find out now rather than later I guess.
